Introduction

Welcome to Dreamer. Please read these Terms of Service carefully before using our Application.

These Terms of Service ("Terms") govern your use of the Dreamer mobile application and website (collectively, the "Application" or "Service") operated by Dreamer ("we", "us", or "our").

By accessing or using the Application, you agree to be bound by these Terms. If you do not agree with these Terms, you may not use the Service.

1. Use of the Service

By using Dreamer, you represent and warrant that:

You are at least 13 years old (or older if required by your local jurisdiction)
You have the legal capacity to agree to these Terms
You will use the Application in accordance with applicable laws and these Terms

2. User Accounts

To use certain features, you may need to register an account. You agree to provide accurate, current information and keep your account credentials secure. You are solely responsible for all activity under your account.

We reserve the right to suspend or terminate your account at any time, for any reason, including violation of these Terms.

3. User Content

You retain ownership of any content you submit to Dreamer, including but not limited to dream recordings and transcriptions ("User Content").

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, process, reproduce, and display your content solely for the purpose of operating and improving the Service.

We will not share or publish your content without your explicit consent, except as required by law.

4. Subscriptions and Payments

Certain features of the Application may require a paid subscription. By subscribing, you agree to pay all applicable fees and taxes.

Billing

Subscription fees will be billed in advance on a recurring basis (monthly or annually, depending on the plan).

Changes

We may change our subscription fees at any time, but will notify you in advance.

Cancellation

You may cancel your subscription at any time via your account settings or by contacting us. You will continue to have access through the end of your current billing period. We do not provide refunds for partial periods.

5. Intellectual Property

Unless otherwise stated, all intellectual property on the Application — including software, text, design, graphics, logos, and trademarks — is owned or licensed by us and protected by copyright and trademark laws.

You may use the Service for personal, non-commercial purposes only. You may not reproduce, distribute, modify, or otherwise exploit any part of the Service without our prior written consent.

6. Third-Party Services

We use trusted third-party providers to help deliver our services, including:

OpenAI and Anthropic for AI-based content generation
Replicate for image generation
Tigris for object storage
Mailgun for email delivery
Stripe for payment processing
Sentry and Uptrace for application monitoring

These providers may process your data solely on our behalf and in accordance with our privacy practices. Use of their services may be subject to their own terms and privacy policies. We never sell your data.

7. Modifications and Interruptions

We reserve the right to modify or discontinue the Application at any time, with or without notice. We are not liable for any interruptions, delays, or service unavailability.

8. Disclaimers

The Application is provided "AS IS" and "AS AVAILABLE." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be error-free, secure, or uninterrupted. Use it at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, Dreamer and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or other intangible losses, arising out of or related to your use of the Service.

Our total liability for any claims under these Terms shall not exceed the greater of (a) the amount you paid us in the past 12 months, or (b) $50.

10. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law principles.

11. Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of the Application shall be resolved through binding arbitration in the State of Wyoming, except where prohibited by law. You waive the right to participate in class actions or jury trials.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date and notify you if the changes are material. Your continued use of the Service after changes take effect constitutes your acceptance.
